The first owner of copyright is the author, but if the author creates the work in the course of employment duties, then the first owner is the employer. Therefore copyright ownership would belong to e.g. ABC NHS Trust.

Copyright ownership should be indicated by the legend © with date and name of the owner e.g. copyright © 2001 ABC NHS Trust. Also, to provide a basis for stopping unauthorised copying by third parties, the Trust should include a brief statement:

All rights reserved. No part of this material may be reproduced or transmitted in any form or by any means without the prior permission from ABC NHS Trust.

Care should be taken when giving literature to outside bodies to avoid as far as possible infringement of the Trust's copyright. A record should be kept of all outside bodies that receive the literature including the date.

To ensure complete copyright in any literature is owned by the Trust, the contract sent to a printer and/or graphic designer should state:

The printed article and graphics contained therein are and shall remain the property of ABC NHS Trust.
